What is a Trademark?

As per Section 2(zb) of the Indian Trademarks Act of 1999, a trademark is a distinctive symbol, design, expression, or identifiable feature that sets a product or service apart from competitors. Trademarks can be owned by individuals, companies, and legal entities, making them accessible to a wide range of applicants.

Why Should You Register Your Trademark?

  1. Legal Protection: Trademark registration offers exclusive rights to use the mark in association with specific goods or services, protecting against infringement.
  2. Brand Recognition: A registered trademark builds trust and credibility among customers.
  3. Exclusive Rights: It grants exclusive ownership rights to the trademark holder, enabling them to take legal action against unauthorized use.
  4. Asset Creation: Trademarks become valuable assets that can be licensed, sold, or transferred.
  5. 10-Year Validity: Once registered, a trademark is valid for 10 years from the date of filing and can be renewedindefinitely.

  7. Sound Mark: Protects unique sounds associated with a brand or company, often used in sound logos or jingles.

Choosing the Correct Trademark Class

Trademark classes categorize goods and services into 45 distinct categories. Selecting the right class is crucial for ensuring that your trademark is valid for the products or services you offer. Key trademark classes include:

  • Class 9: Computer software and electronics
  • Class 25: Clothing

If your business operates in multiple categories, it’s essential to register under each relevant class.
